A scalder army is attacked and takes enough damage to be all killed, but they rolled enough saves to kill the opponent's army with scorching touch. Assume that both armies are the last armies in the game and no SAIs were rolled. Who wins?

That's a good question. There are other possible scenarios that could produce the same result. I'll take a stab at it based on my knowledge of the rules.

Example 1: A Coral Elf army has only one unit left, a Herald. The opponent has a Dwarf army with only one unit left, a Roc with Burning Hands cast on it. The Dwarf army conducts a melee attack at the Coral Elf army and rolls its melee face, which is doubled by the Burning Hands to 8 melee results. The Coral Elf army rolls to save and gets Counter. Since Counter is an SAI, it gets resolved before the army accounts for damage. In this case, the Roc would be killed (there were no magical saves to protect it). Since the Coral Elf player is now the only player with any surviving units in play, the Coral Elf player is the winner.

Example 2: A Scalder army has only one unit left, a Dragonne Tender. The opponent has a Goblin army with only one unit left, a Thug. The Goblin army conducts a melee attack against the Scalder army and rolls its 2 melee face. The Scalder player rolls to save and generates its save face. I would presume that the Scorching Touch racial ability would be resolved before the army accounts for damage. If so, then the Scalder player would win because the Thug would die before the Dragonne Tender.

However, the rules do not say exactly when Scorching Touch should be resolved. Since the wording of the ability is similar to that of the Counter SAI, I would say Scorching Touch is resolved when Special Resolution SAIs are resolved.

Confused Hey Chuck, we need another rules clarification.

Simple rule of thumb. If there is not an obvious order to an attack and counter-attack, then the attacking army's results are first. In this case the critical word missing from the Scalder Scorching Touch description is "immediately". Therefore your first example is correct, since the Counter takes affect immediately, the attacking player loses his last unit(s) and the other player wins as soon as that happens. Since Scorching Touch does not have that word in it's description, the attacking player's damage is accounted for first, and since the defending player's last unit dies first, he loses, and the attacking player wins. Never mind that his unit would die from the burns from touching the Scalder, his unit lives long enough to see the Scalder die first. Smile
